SP Commercial is committed to protecting the privacy of personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
 
This Privacy Policy explains how we manage personal information, including how we collect, use, disclose, store and protect it, and how individuals may access or correct their information or make a privacy complaint.

1. Open and transparent management of personal information (APP 1)
 
We take reasonable steps to implement practices, procedures and systems to ensure compliance with the Australian Privacy Principles and to enable us to deal with privacy enquiries or complaints.
 
This Privacy Policy is available free of charge on our website and can be provided in another format on request.

However, this may not be possible where:

4. Unsolicited personal information (APP 4)
 
If we receive personal information we did not solicit, we will determine whether it could have been collected under APP 3.
If not, and if lawful and reasonable, we will destroy or de-identify the information as soon as practicable.

5. Notification of collection (APP 5)
 
At or before the time we collect personal information (or as soon as practicable afterwards), we will take reasonable steps to inform you of:
  • our identity and contact details;
  • the purpose of collection;
  • any consequences if the information is not collected;
  • the types of third parties to whom we may disclose the information;
  • how to access and correct your information;
  • how to make a privacy complaint;
  • whether overseas disclosure is likely.

6. Use and disclosure of personal information (APP 6)
 
We use and disclose personal information only for the primary purpose for which it was collected, or for a related secondary purpose that you would reasonably expect, unless:
  • you consent;
  • the use or disclosure is required or authorised by law; or
  • another exception under the Privacy Act applies.

7. Direct marketing (APP 7)
 
We may use personal information for direct marketing where permitted by law.
You may opt out of receiving marketing communications at any time by:
  • using the unsubscribe option in communications; or
  • contacting us using the details below.
We do not charge for opt-out requests.

8. Cross-border disclosure of personal information (APP 8)
 
We do not generally disclose personal information to overseas recipients.
If we do, we will take reasonable steps to ensure the overseas recipient complies with privacy protections equivalent to the Australian Privacy Principles, unless an exception under the Privacy Act applies.

9. Government related identifiers (APP 9)
 
We do not adopt government related identifiers (such as Medicare or licence numbers) as our own identifiers.
We only use or disclose such identifiers where permitted or required by law.

10. Quality of personal information (APP 10)
 
We take reasonable steps to ensure that the personal information we collect, use or disclose is accurate, up-to-date, complete and relevant.

11. Security of personal information (APP 11)
 
We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification or disclosure.
Where personal information is no longer required and we are not legally required to retain it, we will take reasonable steps to destroy or de-identify it.

12. Access to personal information (APP 12)
 
You may request access to the personal information we hold about you.
We will respond within a reasonable period and may refuse access only where permitted by the Privacy Act.
If access is refused, we will provide written reasons and complaint options.
A reasonable fee may apply for providing access, but not for making the request.

13. Correction of personal information (APP 13)
 
You may request correction of personal information we hold about you.
If we refuse to correct information, we will provide written reasons and advise how you may complain.
You may also request that a statement be associated with the information.
